All Paper Recycling, Inc. (“APR”), the makers of ShetkaStone, warrants to the original owner that finished ShetkaStone products, permanently and properly installed, after June 1, 2010 will be free from material defects for a period of seven (7) years. This warranty applies to the original owner and is not transferable.

If a ShetkaStone product is found to have a manufacturing defect APR will, at its option, repair or replace without charge or refund, the cost of the ShetkaStone product, excluding shipping charges and costs of removal and reinstallation.

This warranty does not cover any of the following:

• Minor conditions such as stains, scratches, water spots and burns, due to the unique properties of ShetkaStone, which may be corrected by techniques specified in the ShetkaStone CARE AND MAINTENANCE GUIDE.

• Failure of or dissatisfaction with the appearance of joints or seams, or any adhesive, caulk, or other accessory items.

• Dissatisfaction with the appearance of a foreign object in the ShetkaStone product. APR’s quality control process removes a majority of the foreign objects found in the recycled paper products used to produce ShetkaStone. However, APR cannot guarantee 100% that a foreign object, such as a staple, portion of tape, or other object found in the recycled paper, will not end up in a finished ShetkaStone product.

• Failure due to non-compliance with the ShetkaStone INSTALLATION GUIDE or ShetkaStone CARE AND MAINTENANCE GUIDE. Such failures include but are not limited to, failures or defects caused by misuse, abuse, accidents, physical damage, abnormal use, improper handling and storage, neglect, exposure to fire, fluids, biological waste, hazardous materials, chemicals, excessive moisture or dampness, extreme changes in climate or temperature, or alterations.

• Failures due to installation or fabrication not in compliance with the ShetkaStone INSTALLATION GUIDE are the sole responsibility of the installer and/or fabricator.

• Any failures resulting from acts of God, acts of war, riots, natural disasters, including floods, tornadoes, and other extreme weather events.

• Modifications, adaptations, or use of the product outside the environment in which the use of the product was originally intended.

Any information or suggestions concerning applications, specifications or compliance with codes and standards is provided solely for reference and does not include any representation as to the accuracy or suitability of the selection of product for the installation or the design, engineering and construction of the installation. The owner and/or the owner’s agents must verify and test the suitability of any information or products for his or her specific application.

To obtain service under this warranty contact the ShetkaStone dealer from whom you purchased the product. Your ShetkaStone dealer will work with APR to repair or replace any defective ShetkaStone product. If the owner’s principal use of the ShetkaStone product is in the United States (a) this Limited Warranty is governed by the laws of the State of Minnesota, excluding its principles of conflict of laws and (b) in any claim hereunder, the owner consents to the non-exclusive jurisdiction of the state and federal courts situated in Minnesota and waives objection to such venues. (The United Nations Convention on the International Sale of Goods, and any local implementing legislation shall not apply to this Limited Warranty).

THE EXPRESS WARRANTY SET FORTH HEREIN IS THE SOLE AND EXCLUSIVE REMEDY FOR A DEFECTIVE PRODUCT AND IS IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE TO THE EXTENT ALLOWED BY APPLICABLE LAW.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

ALL PAPER RECYCLING, INC. SHALL NOT UNDER ANY CIRCUMSTANCES, WHETHER AS A RESULT OF BREACH OF CONTRACT, BREACH OF WARRANTY, TORT, OR OTHERWISE BE LIABLE FOR DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF A DEFECT IN, THE USE OF, OR INABILITY TO USE SHETKASTONE PRODUCTS. IN NO EVENT SHALL ALL PAPER RECYCLING, INC. BE LIABLE FOR AN AMOUNT GREATER THAN THE VALUE OF PRODUCT.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
This warranty gives you specific legal rights and you may also have other rights which vary from State to State.
